By creating an account or otherwise accessing or using Dofi's website, services, or AI receptionist (collectively, the “Service”), you agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, do not use the Service. If you use the Service on behalf of a business, you represent that you are authorized to bind that business, and “you” refers to that business. These Terms apply within the United States.
Dofi provides an AI-powered phone answering, appointment booking, and service-request intake platform for small businesses. The Service includes:
The Service, including its messaging programs, is operated by Dofi on behalf of each participating business. These Terms apply to every phone number and messaging program Dofi operates for any participating business, now or in the future.
AI identity: Regardless of how a call opens, the Dofi AI agent will never claim to be a human if sincerely asked. This is consistent with FTC deceptive-practices standards and the California BOT Disclosure Act. No US law currently requires AI to proactively announce itself at the start of a phone call.
Human transfer: At any point during a call, you may ask to speak with a human staff member. The AI will transfer you to available staff or take a message if no one is available. You are never required to continue speaking with the AI.
Call recording & consent: Inbound calls handled by the Dofi AI agent may be recorded and transcribed to complete bookings, for quality assurance, and to operate the Service. Many U.S. states — including but not limited to California, Connecticut, Delaware, Florida, Illinois, Maryland, Massachusetts, Michigan, Montana, Nevada, New Hampshire, Oregon, Pennsylvania, and Washington — require all-party consent to record a call. To comply, the AI provides a recording disclosure at the start of every call, regardless of location. Continuing the call after that disclosure constitutes consent. A caller may end the call at any time if they do not wish to be recorded.
Voice data: Dofi transcribes call audio to text to understand and fulfill requests. Dofi does not create, store, or use voiceprints or voice-based biometric identifiers and does not use callers' voices to identify them.
Built-in compliance features: The recording disclosure, AI-identity handling, human-transfer option, and SMS consent prompt described above are provided by the Dofi platform as part of the Service. Individual businesses do not need to build, script, or configure these themselves.
How you opt in. Consent is collected in one of the following ways:
Consent is always optional and is never a condition of purchasing any product, service, or appointment. Declining SMS does not affect your ability to book.
Message types: Transactional and consumer-requested informational messages only — appointment and service-request confirmations, reminders, rescheduling or cancellation updates, and information you specifically request during a call (such as a location or directions link). If a business accepts photo estimates and you send photos by text, you may receive a short reply confirming receipt. We do not send marketing or promotional SMS messages.
Message frequency: Varies based on your booking activity and requests — typically 1–4 messages per appointment or request, plus any individual messages you request. No recurring messages.
Message & data rates: Message and data rates may apply. Check with your mobile carrier for details.
Opt-out: Reply STOP (or STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT) at any time to unsubscribe. You will receive a single confirmation message and no further messages will be sent to your number from that business. Reply START to resume.

Wireless carriers are not liable for delayed or undelivered messages. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text-messaging originator opt-in data and consent will not be shared with any third parties, excluding the vendors and subcontractors who act on Dofi's behalf solely to deliver the messages you have consented to receive and who may not use that information for any other purpose. Plans & fees: The Service is offered to business owners (Clients) as a monthly subscription. Pricing is based on the size of your team, as published at trydofi.com or as otherwise agreed with you in writing. All fees are in U.S. dollars.
Free trial: From time to time we may offer a free trial to new Clients. When a free trial is available, its length is stated at the time you sign up (for example, on our pricing or signup page). No payment method is required to sign up. After we set up your AI receptionist, we will email you to confirm it is ready and invite you to add a payment method. Your free trial begins when you add a valid payment method and runs for the stated number of days; you are not charged during the trial. Unless you cancel before the trial ends, your paid subscription begins automatically when the trial ends and the payment method on file is charged for your selected plan, renewing monthly until you cancel. We will remind you before your trial ends. A free trial is not guaranteed and may be changed, limited, or discontinued at any time. If no free trial is offered, a plan and payment method are required to activate the Service.
Billing: Subscriptions are billed monthly in advance and processed by our payment provider, Stripe. By subscribing, you authorize recurring monthly charges to your payment method until you cancel. Dofi does not collect or store your full card details — payment information is handled by Stripe.
Cancellation: You may cancel at any time by emailing contact@trydofi.com or through the Stripe customer portal. Cancellation takes effect at the end of the current billing period, and you keep access until then. Except where required by law, fees already paid are non-refundable.
Failed payments: If a payment fails, we will notify you and retry the charge. We may suspend the Service if payment remains outstanding after reasonable notice.
Price changes: We may change subscription pricing with at least 30 days' notice by email. Changes take effect at your next billing period after the notice. If you do not agree to a price change, you may cancel before it takes effect.
Fair use: Each plan includes call volume reasonably typical of a business of that plan's size. If sustained usage substantially exceeds typical volume, we may contact you about moving to a plan that fits your usage — your fee will never change without notice to you.

Dofi provides the AI disclosure, call-recording notice, human-transfer option, and SMS consent prompt as part of the Service, so you are not responsible for building or scripting these compliance features yourself.
You may not use the Service to:
Our intellectual property: All software, technology, content, trademarks, and materials within the Service are the property of Dofi or its licensors and are protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your business during your subscription. You may not copy, modify, distribute, reverse-engineer, or create derivative works without our prior written consent.
Your data: As between you and Dofi, you (the Client) own the business and customer data generated through your use of the Service, including booking and call records associated with your business. You grant Dofi a license to host, process, and use that data as needed to provide and operate the Service. Dofi may also use de-identified and aggregated data — which does not identify you or any caller — to maintain, improve, and develop the Service.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted or error-free, or that AI responses will be accurate at all times. You are responsible for reviewing bookings and outcomes generated by the AI.
Software and services sold “as is”; no insurance. All software, features, integrations, and related services that Dofi provides or sells are licensed and provided on an “as is” and “as available” basis. Dofi is a software tool and does not act as an insurer, guarantor, or business partner. We do not guarantee any particular business result and provide no insurance, indemnity, or financial guarantee against missed or delayed calls, missed or incorrect bookings, lost customers, lost revenue, or any other business losses arising from your use of or reliance on the Service. You are solely responsible for operating your business and for obtaining any insurance you consider appropriate for it.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DOFI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF REVENUE, LOST BOOKINGS, OR DATA LOSS, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS PRECEDING THE CLAIM. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
You agree to indemnify and hold harmless Dofi and its officers, directors, employees, and agents from any third-party claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms, your misuse of the Service, or your violation of applicable law or the rights of a third party. This does not apply to claims arising from the Service operating as designed or from Dofi's own violation of these Terms or applicable law.
Either party may terminate the service relationship at any time. We reserve the right to suspend or terminate your access to the Service immediately if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to other users or to Dofi. Upon termination, your right to use the Service ceases immediately.
Any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, rather than in court — except that either party may (a) bring an individual claim in small-claims court, and (b) seek injunctive or other equitable relief in court for actual or threatened infringement or misappropriation of intellectual property or unauthorized access to the Service.
Class action waiver: Disputes will be conducted only on an individual basis and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims. If this class action waiver is found unenforceable, then the entirety of this arbitration provision shall be null and void.
Arbitration will take place in California unless you and Dofi agree otherwise, and judgment on the award may be entered in any court of competent jurisdiction.
These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict-of-law principles. Subject to the arbitration provision above, any dispute not subject to arbitration shall be resolved exclusively in the state or federal courts located in California, and you consent to personal jurisdiction there.
Entire agreement: These Terms, together with the Privacy Policy and any data processing addendum or order form between Dofi and a Client, constitute the entire agreement between you and Dofi regarding the Service.
Severability: If any provision is held unenforceable, the remaining provisions remain in full effect.
Assignment: You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
Force majeure: We are not liable for any delay or failure caused by events beyond our reasonable control.
No waiver: Our failure to enforce any provision is not a waiver of it.
Notices: We may provide notices to you by email or by posting on our website.
We may update these Terms from time to time. We will notify registered business owners by email and update the effective date above. Continued use of the Service after changes constitutes acceptance of the updated Terms.
